When you place an order, you are making an offer to purchase the products in your order. An order confirmation acknowledges that we have received your order but does not necessarily mean that we have accepted it.
A contract is formed when we confirm that your order has been accepted or dispatched, whichever occurs first.
We may refuse or cancel an order where:
(a) a product is unavailable;
(b) payment cannot be authorised;
(c) the billing or delivery information is incomplete or inaccurate;
(d) we reasonably suspect fraud, unauthorised resale or misuse;
(e) a product or price has been displayed in obvious error; or
(f) accepting the order would breach applicable law.
If we cancel an order after payment has been taken, we will refund the relevant amount using the original payment method, unless another method is agreed.
We may limit quantities purchased per person, household or order. These restrictions may apply to orders using the same customer account, payment method, billing address or delivery address.
You agree to provide accurate, current and complete purchase, billing, delivery and account information. You should promptly update your contact and account information when it changes.

SECTION 7 – DELIVERY
Delivery options, charges and estimated delivery times will be displayed during checkout or explained in our Shipping Policy.
Delivery dates are estimates unless we have expressly agreed that delivery by a particular date is essential.
International orders may be subject to customs charges, import duties, taxes or other fees imposed by the destination country. Where these charges are not collected during checkout, they are normally the customer’s responsibility.

SECTION 8 – CANCELLATIONS, RETURNS AND STATUTORY RIGHTS
Consumers purchasing online may have a legal right to cancel most purchases within 14 days after receiving the goods, without giving a reason. After notifying us of a cancellation, the consumer will generally have a further 14 days to return the goods.
Exceptions may apply, including to certain personalised products and sealed audio recordings, sealed video recordings or sealed computer software where the seal has been broken after delivery.

If you are returning an item because it is faulty, damaged, not as described or otherwise does not comply with the contract, your statutory remedies apply. These may include repair, replacement, a price reduction or a refund, depending on the circumstances.
Nothing in these Terms or our policies excludes or limits rights that cannot lawfully be excluded or limited under Irish or applicable consumer law.

The failure of Dolphin Traders Ltd to enforce a provision on one occasion does not waive its right to enforce that provision later.

These Terms and any contract formed through EssentialIrish.com are governed by the laws of Ireland.
If you are a consumer living outside Ireland, you may also benefit from mandatory protections provided by the laws of your country of residence.
The courts of Ireland will have jurisdiction over disputes relating to these Terms or the Service. If you are a consumer, this does not prevent you from exercising any right to bring proceedings in another court available to you under applicable law.

We may update these Terms to reflect changes to the Service, our business practices or applicable law.
The current version will be published on this page together with its most recent update date. Changes will not retrospectively reduce rights relating to an order already accepted.
